GlowPAS website consists of a network of websites and web pages operated by GlowPAS and its members and providers (collectively referred to as GlowPAS Website hereafter). GlowPAS website is available for you to use upon the non-conditional agreement on the terms of use with no modifications to any of the conditions and notices. Using GlowPAS website means that you agree to the terms of use. Using a specific section of GlowPAS website may require agreeing to additional terms provided elsewhere in this agreement r in the section itself (Additional Terms). In case of contradiction between any of the terms in this agreement and any Additional Terms, the latter prevails.
Access to some sections on the website is restricted to registered users or members or providers or any other person with a user’s account (Registered Users’ Zone). Unauthorized use of such sections is strictly prohibited and may subject you to legal accountability. In order to be granted the right to access this zone, you need a user’s account, which you may obtain upon submitting your personal info correctly and accurately in the application form. During registration, you will have to select a username and password, whose privacy is your sole responsibility. You are also solely responsible for any activity in your account whatsoever. You agree hereby to inform GlowPAS and / or security authorities in case of unauthorized use of your account. GlowPAS will not be responsible for any losses you may suffer due to such unauthorized use or in any case where someone uses your username and/or password with or without your consent. Under any conditions, you will be held responsible for any losses GlowPAS and/or any related body or section on the website may suffer due to the use of your username and password by anybody with or without your consent.
You can use GlowPAS website for your personal non-commercial purposes after agreeing to the terms of this agreement. Under any conditions, you are not allowed to modify, copy, distribute, send, present, reproduce, publish, license, reproduce in different forms, transfer or sell any data or software or products or services you obtained from GlowPAS website for any purpose without written permission from GlowPAS.
As an essential condition to use GlowPAS website, you have to agree that you will not use the website for any activity that is illegal and/or prohibited by any law and/or contradictive with the terms of this agreement.
Using GlowPAS website should not cause any damage or weakness and should not be in the purpose of causing any damage of weakness to the website or the network related to the website, and should not interfere with the usage of this website or network by others. Attempting illegal access to other’s accounts or to sections on the website where access is restricted or to the computer systems or servers or networks connected to the website or networks hosting the website through hacking or manipulation of passwords or any other means is strictly prohibited. You are not allowed to obtain or attempt obtaining any data or products other than what is made available for you.
GlowPAS website contains special sections for information, news, messages, chat, newsletters, bulletin boards or any other means of communication that is designed to facilitate communication between users. You agree to use such sections only for the purposes for which they were designed, that is to say, to send or receive texts or messages or material that does not contradict in any way with the terms of this agreement and/or law. You agree that you will NOT use these sections for any of the following purposes:
- Creating links, forward chains or junk mail, or conducting surveys or polls or unauthorized discussions.
- Deforming or abusing others’ rights or threatening or harassing others.
- Publishing, submitting or creating any illegal material.
- Violating copyrights, or trademarks or licenses or confidential data or any rights of any third party.
- Uploading files that contain viruses, trojans, worms, time bombs, corrupt files, or any other malware or dangerous files or software that may cause any sort of loss or damage to the software or hardware of others or to the website or to servers hosting the website or to any related links or other parts of the network.
- Advertising or offering buying or selling any products or services for commercial purposes.
- Advertising or offering buying or selling any products or services for commercial purposes.
- Uploading or transferring any material or files sent by others or files that may identify others or any material whose transfer is for any reason prohibited by law.
- Depriving any other user from using the website.
- Collecting personal data.
- Violating any rules or regulations.
- Forging fake identities in order to use them to deceive others.
- Downloading or copying or making any files or guidebooks or other material including users’ data and website data available for any person who is not entitled access to sections that contain such material.
GlowPAS does not conduct ongoing surveillance on the data zone or any others section of GlowPAS website. But GlowPAS reserves the right to conduct check-ups at any time and to review contents of any material communicated through the website, as well as to remove any material whenever necessary. GlowPAS has the absolute control over this issue with no limitations or conditions. GlowPAS does not control or certify any messages or material communicated through the website by users or visitors. Thereby GlowPAS is not responsible for the content of any such material or any other activity performed by users or visitors. Upon communicating any material through GlowPAS website or any of its services or sections or other related websites operated by GlowPAS, you are granting GlowPAS the copyright of what you communicate. GlowPAS will have the right to use, reproduce, publish, translate, edit or modify such material directly or by granting the right to a third party, for commercial and non-commercial purposes and in any for whether media or technology or other forms whether known now or to be encountered in the future. Upon uploading or sending or transferring or making any material available of GlowPAS website, you certify that you hold the rights of this material, including the copyrights to use or modify the material with no limitations. This is an important prerequisite to be able to communicate such material.
GlowPAS has the restrictive right to facilitate your access to GlowPAS website or any of its services and sections at any time with no need for prior permission. GlowPAS may suspend your access to the website for reasons of inconsistency, defined as failing to access or participate in any service for a predefined period of time (defined solely by GlowPAS). Upon suspension of your access, your right to use the website is withheld immediately.
GlowPAS website may contain links to third party websites. GlowPAS does not control such websites and is not responsible for their contents or contained links or any modifications or updates to them. You are required to review the privacy policy and terms of use for these websites. Dealing with such related websites or participating in promotion for such websites, including delivery of products or services or payments or dealing with any conditions or warranties or data is the sole responsibility of that who conducts such activity and GlowPAS is not responsible for any aspect of such issues.
GlowPAS website provides knowledge, training and other services to GlowPAS employees and clients and participants in any of GlowPAS programs. GlowPAS clients are usually businesspeople or training firms or organizers of training events or trainers or trainees. GlowPAS provides services designed by GlowPAS or any of its providers and hosted on clients’ websites. GlowPAS collects data about users of such services under supervision of GlowPAS clients.
Agreements between GlowPAS and its clients may necessitate the transfer of personal data about clients or users, in order to facilitate access to the network with what it contains of data and training and any other services. GlowPAS may collect the following data:
- User name
- Password
- Address location and rank in the clients’ systems.
GlowPAS may also track the amount of time a User spends on the customer web site, the applications the User employs, the self-tests the User performs, the User's performance on such tests, and other activities in which the User engages while the User is on the web site.
GlowPAS may use non-personal data that it obtains from Users, such as the amount of time Users spend on a specific portion of a web site, to analyze trends, to gather data to benchmark best practices, and to monitor, improve and refine the functionality of the system.
GlowPAS generally only uses personal information to provide feedback about a User's activity on an GlowPAS-hosted customer web site. For example, GlowPAS may use personal information to inform a User of his or her performance on tests, or the number of training modules that a User has used. GlowPAS may also use personal information to send e-mails to a User, such as reminder e-mails that the User has not completed certain online courses. GlowPAS may also suggest which online courses are most suitable for a User.
GlowPAS's arrangements with its customers( from GlowPAS) may require GlowPAS to provide all User information that are in it's possession, including a User's personal information, directly to the customer with which the User is associated (i.e. the User's employer). If a User corresponds with GlowPAS, GlowPAS may keep a record of that correspondence. GlowPAS may also forward correspondence to the customer which the User is associated. GlowPAS does not transfer any personal User information to any third party (other than GlowPAS's customer) unless it is authorized to do so by the customer with which the User is associated, or required to do so.
GlowPAS AND ITS RESPECTIVE AFFILIATES AND SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, LACK OF VIRUSES OR OTHER HARMFUL COMPONENTS AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED CONTENT CONTAINED WITHIN GlowPAS WEBSITE FOR ANY PURPOSE. GlowPAS WEBSITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. The information, products, and services included in or available through GlowPAS Website may include erratum. Changes are periodically made to GlowPAS Website and to the information therein. GlowPAS and/or its respective affiliates and suppliers may make improvements and/or changes in GlowPAS Website at any time.

Any kind of the training programs available on this Web Site (the training programs or its supplements ) that is made available to download from this Web site is the copyrighted work of GlowPAS, its affiliates, and/or their suppliers. Your use of the training programs or its supplements is governed by the terms of the end user license agreement, if any, which accompanies, or is included with, "the Training Programs or its supplements" ('License Agreement"). You may not install or use any \"Training Programs or its supplements\" that is accompanied by or includes a License Agreement unless you first agree to the License Agreement terms.

This agreement is governed by the laws of the United Kingdom. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Manchester city, United Kingdom. in all disputes arising out of or relating to the use of GlowPAS Website.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and GlowPAS as a result of this agreement or use of GlowPAS Website.
You agree to indemnify, defend and hold GlowPAS, its parents, subsidiaries, affiliates, suppliers, officers, directors and employees harmless from any and all third party claims, liability, demands, damages and/or costs, including reasonable attorneys' fees, arising from your use of or conduct on GlowPAS Website, your violation of this agreement, or your infringement of any intellectual property or other right of any person or entity.
GlowPAS reserves the right to disclose any personal information about you or your use of GlowPAS Website, including its contents, without your prior permission if GlowPAS has a good faith belief that such action is necessary to:
- Conform to legal requirements or comply with legal process
- Act to protect the interests of its members.
- Enforce the terms of service.
- Act to protect the interests of its members.
If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and GlowPAS with respect to the GlowPAS Website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and GlowPAS with respect to the GlowPAS Website.
A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions , the other related similar documents will be presented.
Because legal regulations vary from one governmental agency's jurisdiction and because our franchise locations are controlled, GlowPAS's policies on issues such as cancellations and refunds may vary from location to another. Please be certain that you receive and understand the written policies that are in force for the location with which you deal with.
